What does the law say about private CCTV systems?

CCTV is an effective deterrent and a tool on which many people rely on. If you are thinking of installing CCTV at your property, you need to know what the law says.

  • Use and siting of the camera

If you live of a busy road, you may have been told that CCTV is not possible because it infringes on people walking past on the pavement, car drivers and so on.
This doesn’t stop you having CCTV but you will need to bear in mind that where the camera or cameras are fixed needs to be in keeping with protecting your property.

In other words, you are collecting information about what is happening on your property, without overly infringing of other people’s rights to privacy.
You also need to inform people that they are under CCTV surveillance.

  • Not collecting excessive evidence

Have you noticed the questions you are asked on forms you are completing, or the information others gather on you? Do you stop to ask why they need to know that snippet of information about you?

If you ask, quite often they don’t know or they say they have ‘always gathered that information from people’. This is not acceptable and the same is true with CCTV.

You should only gather and keep information that you need to, and information which is not excessive. In other words, ensure that your cameras are gathering information on your property and if you no longer need it, delete it.

  • Information is securely kept and for no longer than is required

A CCTV system at a property will gather a lot of information over a 24-hour period. You need to ensure that this information is kept securely and that you get rid of it (safely), when you no longer need it.

Thus, CCTV footage from two years ago, is perhaps an excessive amount of time to keep the information, unless you have reason to believe it is important.
